Terms and conditions for waterproofing services

These Terms of Service ("Terms") govern your use of services provided by Spartan Waterproofing (ABN 74 677 786 720, QBCC License 15456097). By engaging our services, you agree to be bound by these Terms.
1. Services Provided
Spartan Waterproofing provides professional waterproofing services including:
- Bathroom and shower waterproofing
- Balcony and deck waterproofing
- Planter box and retaining wall waterproofing
- Leak detection and repair
- Waterproofing membrane installation
- Related construction and preparation work
2. Quotes and Pricing
Quote Validity
Written quotes are valid for 30 days from the date of issue unless otherwise specified. Prices may be subject to change after this period.
Payment Terms
- Deposit may be required before work commences
- Progress payments may be requested for larger projects
- Final payment is due upon completion of work
- Accepted payment methods: Bank transfer, cash, credit card (surcharge may apply)
Additional Costs
Additional charges may apply for:
- Variations to the original scope of work
- Unforeseen structural issues discovered during work
- Changes requested by the client after work has commenced
- Access difficulties not disclosed during the quoting process
3. Client Responsibilities
The client agrees to:
- Provide accurate information about the property and scope of work
- Ensure clear and safe access to work areas
- Remove or protect valuable items in work areas
- Notify us of any relevant building or strata requirements
- Obtain necessary approvals or permits where required
- Ensure pets are secured during work hours
4. Our Responsibilities
Spartan Waterproofing commits to:
- Perform work in a professional and workmanlike manner
- Use quality materials suitable for the application
- Comply with relevant Australian Standards and Building Codes
- Maintain appropriate licenses and insurance coverage
- Communicate clearly about project timeline and progress
- Leave work areas clean and tidy upon completion
5. Warranties and Guarantees
Workmanship Warranty
We provide a warranty on our workmanship in accordance with Australian Consumer Law and Queensland building industry standards. Specific warranty periods will be detailed in your written quote or contract.
Product Warranties
Manufacturer warranties apply to materials used. We will provide documentation for applicable product warranties.
Warranty Exclusions
Warranties do not cover:
- Damage caused by client or third-party actions
- Normal wear and tear
- Failure to maintain waterproofed areas as recommended
- Structural movement or building defects not caused by our work
- Acts of nature, extreme weather events, or force majeure
6. Scheduling and Delays
We will make reasonable efforts to complete work within agreed timeframes. However, completion dates may be affected by:
- Weather conditions
- Access issues
- Discovery of unforeseen problems
- Material supply delays
- Client-requested changes
We will communicate any delays promptly and work to minimize disruption.
7. Cancellation and Rescheduling
By Client
Cancellation or rescheduling requests must be provided with at least 48 hours notice. Late cancellations may incur a fee to cover preparation costs.
By Spartan Waterproofing
We reserve the right to reschedule work due to weather, safety concerns, or unforeseen circumstances. We will provide as much notice as possible.
8. Liability and Insurance
Spartan Waterproofing maintains appropriate public liability insurance and workers' compensation coverage as required by law. Our liability is limited to:
- Direct damages caused by our negligence
- Amounts covered by our insurance policies
- Requirements under Australian Consumer Law
We are not liable for pre-existing conditions, damage to items not removed from work areas, or consequential damages beyond our direct control.
9. Intellectual Property
Photos and descriptions of completed work may be used by Spartan Waterproofing for marketing and promotional purposes unless the client specifically requests otherwise in writing.
10. Dispute Resolution
In the event of a dispute:
- Contact us directly to discuss concerns
- We will work in good faith to reach a fair resolution
- If unresolved, disputes may be referred to the Queensland Building and Construction Commission (QBCC)
- Formal mediation or legal action may be pursued as a last resort
11. Compliance with Laws
All work is performed in accordance with:
- Queensland Building and Construction Commission regulations
- Australian Standards (AS 3740 and related standards)
- Local council requirements
- Workplace health and safety legislation
- Environmental protection requirements
12. Privacy
We collect and handle personal information in accordance with our Privacy Policy and the Australian Privacy Act 1988.
13. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the Queensland courts.
14. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of our services constitutes acceptance of updated Terms.
